Terms and Conditions of Sale
Article 1 — Products
The products offered for sale are original photographic prints of press and reportage from the 20th century, as well as related objects (posters, books, archival documents). Each print is unique and sold in the condition described on its listing.
Article 2 — Prices
Prices are indicated in euros (EUR), all taxes included. Shipping costs are added to the price according to the destination zone and are displayed before order confirmation.
Article 3 — Payment
Payment is made online via Stripe, by bank card. The order is confirmed upon receipt of payment. Behind Headlines will contact you within 24 hours to confirm preparation and shipping.
Article 4 — Shipping
Shipping costs: France €15, European Union €25, rest of the world €45. Prints are carefully packaged and shipped within 3 to 7 business days. A tracking number is provided by email.
Article 5 — Right of withdrawal
Under Article L221-18 of the French Consumer Code, the consumer customer has a 14-day period from receipt of their order to exercise their right of withdrawal. The detailed conditions for exercising this right, for returns and for refunds are set out in Section V — Returns, withdrawal and refunds.
Article 6 — Warranties
In accordance with Articles L217-4 et seq. of the French Consumer Code, prints conform to the description on their listing. Vintage prints show signs of use inherent to their nature and age, as indicated in the description.
Article 7 — Disputes
In the event of a dispute, an amicable solution will be sought first. Failing that, the dispute falls under the jurisdiction of the French courts. The consumer mediator may be referred to in accordance with Articles L612-1 et seq. of the French Consumer Code.
Returns, Withdrawal and Refunds
V.1 — Particular nature of the prints offered
The Products offered for sale by the Gallery are vintage, antique and/or collectible press photographic prints.
Each print may, by reason of its age, storage conditions, history and very nature, exhibit characteristics typical of antique photographs: variations in tone, signs of age, light scratches, creases, handling marks, marks on the reverse, perforations, staples, annotations, stamps, slight paper alterations or other signs of age and use.
Where these characteristics are visible or known to the Gallery, they are described in the Product listing and/or illustrated by the photographs shown on the Site.
These characteristics, where they are expressly described before the order, constitute characteristics known and accepted by the Customer at the time of purchase and cannot, on their own, be invoked subsequently to demand cancellation of the sale or a refund on the grounds of a defect of conformity.
The Gallery endeavours to provide a description of each piece that is as faithful and accurate as possible. The photographs shown on the Site also constitute an element of information regarding the apparent condition of the Product.
V.2 — Legal right of withdrawal
Where the Customer is a consumer and the sale is concluded at a distance, the Customer has, in accordance with applicable regulations, a period of fourteen (14) days from receipt of the Product to exercise their legal right of withdrawal, subject to any applicable legal exception.
The exercise of this right may not be subject to justification of a reason.
The mention of any commercial policy of "final sale" shall not have the effect of depriving the consumer Customer of their legal right of withdrawal where it is applicable.
V.3 — Return conditions
Any Product returned in the context of a withdrawal must be returned complete and in the condition in which it was received, subject to manipulations strictly necessary to enable the Customer to establish the nature, characteristics and proper functioning of the Product.
Given the antique and particularly fragile nature of certain prints, the Customer must take all necessary precautions to avoid any deterioration during the period in which the Product is in their custody and during its return.
The Customer must in particular:
- keep the Product in conditions suitable for its conservation;
- avoid prolonged exposure to humidity, heat sources, direct sunlight or any other element likely to damage it;
- not fold, roll, cut, perforate, annotate or alter the print;
- not apply any adhesive, glue, fastening or any other element to the print;
- not carry out any framing, unframing, mounting or any other transformation likely to alter the Product;
- return the Product in packaging that is sufficiently protective and suited to its nature.
The Customer is responsible for any depreciation resulting from manipulations exceeding those necessary for the examination of the Product, within the limits provided by applicable regulations.
V.4 — Condition of the Product upon return
Given the vintage, antique and potentially unique or irreplaceable nature of the Products, the Gallery pays particular attention to their condition at the time of dispatch and upon their return.
Prior to each dispatch, the Gallery may retain dated photographs of the Product, of its apparent condition, of any particular features and of its packaging.
These elements may be retained for evidentiary purposes and for comparison with the condition of the Product upon its possible return.
Upon receipt of a return, the Gallery may carry out any verification reasonably necessary to ascertain the condition of the Product.
Where the Product exhibits deterioration, modification, degradation or loss of an element that was not present at the time of dispatch, the Gallery may take account of the depreciation actually observed in the refund amount, in accordance with applicable legal provisions.
Where the depreciation is significant or the Product can no longer be resold in its original condition, the Gallery may apply a reduction in the refund corresponding to the depreciation actually suffered.
No deduction shall be applied solely on the grounds that the outer packaging has been opened or that the Product has been subject to manipulations strictly necessary for its examination.
V.5 — Return costs
In the context of exercising the legal right of withdrawal, the direct return costs of the Product are borne by the Customer, unless there is a contrary legal provision or express agreement from the Gallery.
The Gallery strongly recommends that the Customer use a delivery service providing parcel tracking and, for Products of significant value, insurance appropriate to the value of the Product.
The Gallery cannot be held responsible for loss or deterioration of the Product during its return where this is attributable to the carrier or results from insufficient packaging by the Customer, subject to applicable mandatory legal rules.
V.6 — Refund
Where the right of withdrawal is validly exercised, the Gallery shall refund the sums due to the Customer in accordance with applicable regulations.
The refund includes the delivery costs corresponding to the standard delivery method offered by the Gallery at the time of the order.
Where the Customer has expressly chosen a delivery method more expensive than the standard delivery method offered by the Gallery, the supplement corresponding to that choice is not refunded.
The direct return costs remain borne by the Customer under the conditions set out in Article V.5.
The Gallery may defer the refund until recovery of the Product or until receipt by the Gallery of proof of its dispatch by the Customer, the date retained being that of the first of these events.
The refund is made according to the methods and within the time limits provided by applicable regulations.
V.7 — Products returned incomplete, damaged or different
Any returned Product must correspond to the Product dispatched by the Gallery and include, where applicable, all elements, accessories, documents or components that accompanied it at the time of dispatch.
The Gallery reserves the right to verify that the returned Product indeed corresponds to the Product sold and that no substitution, modification or deterioration has occurred after its dispatch.
In the event of a difference between the dispatched Product and the returned Product, of substitution, disappearance of an element or deterioration attributable to the Customer, the Gallery may take account of the depreciation actually suffered within the limits authorised by law.
The Gallery may retain the elements necessary to establish this finding, including photographs, videos, internal references, inventory numbers or condition descriptions.
V.8 — Products damaged during outbound transport
The Customer is invited to check the apparent condition of the parcel upon delivery.
In the event of a visibly damaged parcel, the Customer is invited, where possible, to make any reservation or useful step with the carrier and to retain the elements enabling documentation of the parcel's condition.
In the event of damage observed on the Product upon receipt, the Customer must contact the Gallery as soon as possible and, if possible, transmit photographs of the outer parcel, inner packaging and the Product.
This request for information has the sole purpose of enabling the Gallery to identify and effectively process the damage. It does not deprive the Customer of their legal rights.
V.9 — Non-conforming Product or Product with an undisclosed defect
The provisions relating to the right of withdrawal do not deprive the consumer Customer of the applicable legal guarantees.
Where a Product exhibits a defect or non-conformity that was not indicated in its description before the sale, the Customer may exercise the rights they benefit from under the legal guarantees, under the conditions provided by applicable regulations.
Signs of age, traces of use, marks, aesthetic defects or particularities expressly mentioned in the Product listing before the order do not, in themselves, constitute undisclosed defects.
V.10 — No returns for convenience outside the legal right
Outside the legal right of withdrawal where applicable, the legal guarantees and any particular obligation resulting from the law, the Gallery is not obliged to accept any return or refund for the Customer's personal convenience.
Any exceptional acceptance of a return or refund by the Gallery constitutes a one-off commercial gesture and may not create an acquired right for subsequent orders.
V.11 — Abusive or manifestly unfounded claims
The Gallery reserves the right to request from the Customer any element reasonably necessary for the examination of a claim concerning the condition, conformity or receipt of a Product.
The Gallery may in particular request photographs or any other element enabling identification of the Product and establishment of the problem invoked.
This faculty may not have the purpose or effect of obstructing the exercise of the Customer's legal rights.
Any refund request remains subject to the conditions provided by law and to the stipulations of these Terms and Conditions.
V.12 — Mandatory provisions
No provision of these Terms and Conditions has the purpose or effect of excluding or limiting the rights that the consumer Customer imperatively benefits from under the right of withdrawal or the legal guarantees.
In the event that a provision of these Terms and Conditions is declared inapplicable or deemed unwritten by reason of a mandatory legal provision, the other stipulations shall remain applicable to the extent permitted by the regulations.
Privacy & GDPR
Behind Headlines collects personal data only in the following cases:
- Contact form: email address and message content, in order to respond to your request.
- Stripe payment: name, email address and shipping address, necessary for order processing and shipping. Bank details are processed directly by Stripe and are never stored by Behind Headlines.
- User account: email address, exclusively for access to the site's administration.
Your data is retained for as long as necessary for the purpose of collection (order processing, responding to a message) and thereafter in accordance with legal retention obligations.
